Welcome to Classicbuy. It is a requirement to publish the rules, regulations, privacy policy, and Terms of Use for accessing or using the Classicbuy marketplace platform - classicbuy.in (referred to as the "Platform").

Your use of Classicbuy and its services and tools is governed by the following terms and conditions ("Terms of Use"), applicable to Classicbuy, including the relevant policies incorporated herein by reference. By using Classicbuy, you enter into a contract with SUPERINNOV ASSOCIATES PRIVATE LIMITED, the Platform's owner. These terms, along with the policies, constitute your binding obligations with Classicbuy.

For the purposes of these Terms of Use, "You" or "User" refers to any natural or legal person who becomes a buyer on the Platform by providing data during registration as a Registered User. The terms "Classicbuy," "We," "Us," and "Our" refer to Classicbuy Designs Private Limited and its affiliates.

When utilizing any services provided by Us through the Platform (e.g., Product Reviews, Seller Reviews), you are subject to the rules, guidelines, policies, terms, and conditions applicable to such services. These are deemed incorporated into these Terms of Use and are considered part of it. We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms of Use without prior written notice. It is your responsibility to review these Terms of Use periodically for updates/changes. Continued use of the Platform after changes are posted indicates your acceptance and agreement to the revisions. As long as you comply with these Terms of Use, We grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform. By accepting these Terms of Use, you also agree to be bound by Classicbuy Policies, including the Privacy Policy, as amended from time to time.

User Account, Password, and Security

If you choose to utilize the Platform, you are responsible for safeguarding the confidentiality of your Display Name and Password. All activities conducted under your Display Name and Password are your responsibility. Providing inaccurate or incomplete information may result in the indefinite suspension, termination, or blocking of your access to the Platform by us in accordance with these Terms of Use.

If there is a suspicion of a security breach or misuse of your account, we may request a password change or suspend your account without liability. Any loss or damage resulting from your failure to comply with these provisions is not the responsibility of Classicbuy.

To enhance security and privacy, Classicbuy may moderate users associated with a device. Your mobile phone number is considered your primary identifier, and it is your duty to keep it updated. Failure to notify us promptly of any changes to your mobile phone number or email address may result in Classicbuy not being liable for any activities under your account. Immediate notification of unauthorized use or breaches is required.

Sharing your account or allowing others access makes you solely liable for all activities on your account. If your account remains inactive for two years, your data, including transactional data, will be deleted from our records.

Services Offered

Classicbuy provides various Internet-based services, allowing users to purchase original merchandise, including clothing, footwear, and accessories from fashion and lifestyle brands ("Products"). Users can buy Products through different payment methods. Policies governing the sale/purchase of Products, such as cancellation, exchange, and return policies, are specified in the FAQ section and are incorporated into these Terms of Use.

Users must confirm the unused status and intact original tags when creating a return request. If the product is used, damaged, or missing original tags, the return request will be declined, and the product will be re-shipped to the customer. In such cases, users are not eligible for a refund, and Classicbuy assumes no liability.

Product-specific conditions may supplement these Terms of Use and will be displayed with the respective Products. Classicbuy does not guarantee the accuracy, completeness, reliability, or error-free nature of Product descriptions or other content on the Platform and assumes no liability in this regard.

Platform for Transaction and Communication

Users engage on the Platform to meet and interact for transactions, and Classicbuy is not a party to or in control of any such transactions. Therefore:

• Commercial/contractual terms are solely between Buyers and Sellers, including price, shipping costs, payment methods, and warranties. Classicbuy has no control over these terms.

Classicbuy makes no representation or warranty regarding product specifics, quality, value, or other aspects of items offered on the Platform.

• Classicbuy is not liable for non-performance or breaches of contracts between Buyers and Sellers, and it cannot guarantee the performance of any transaction.

• Classicbuy does not hold any rights or obligations over products, and the contract for sale is strictly between the Seller and the Buyer.

• The Platform is a communication tool for buying and selling, and Classicbuy is not responsible for unsatisfactory services or delays due to product availability issues.

• Pricing discrepancies may occur due to technical issues, typographical errors, or incorrect seller information, leading to order cancellations.

• Users release and indemnify Classicbuy from any consequences of actions taken by other Users and waive any claims under applicable law.

User Conduct and Rules on the Platform

Users agree to abide by the following principles:

• Users shall not share misleading, harmful, or illegal information and shall not engage in activities that violate laws or infringe on others' rights.

• Users will not use the Platform for unauthorized access, fraudulent purposes, or impersonate others.

• Users shall comply with applicable laws, including the Information Technology Act, 2000, and respect Classicbuy's policies and rules.

• Users must not engage in hacking, password mining, or any other illegitimate means to access the Platform.

• Users are responsible for providing accurate information about products and services and refraining from false advertising.

• Users shall not engage in unlawful or fraudulent activities on the Platform, causing annoyance or inconvenience to others.

• Users shall not pretend to be someone else, mislead Classicbuy, or use false email addresses.

• Users shall not engage in unauthorized access attempts or misrepresent their identity.

• Users shall not use the Platform for unlawful or fraudulent purposes that may cause interruptions, damages, or loss to Classicbuy.

• Users shall not engage in bulk or fraudulent orders, and Classicbuy may cancel such orders.

• Classicbuy does not facilitate business-to-business transactions, and users are advised against transacting if seeking input tax credit benefits.

• Users shall not misuse the platform for unsolicited advertisements, and any user-generated content must adhere to these Terms of Service and Privacy Policies.

• Users shall not use automated devices or methodologies to access or acquire content from the Platform without authorization.

• Users shall comply with applicable laws, both domestic and international, regarding their use of Classicbuy's services.

• Users are responsible for providing accurate information about the products or services they intend to sell.

• Classicbuy disclaims responsibility for the views expressed in user-generated content and claims no liability for any damages resulting from such content.

• Classicbuy may unilaterally terminate user accounts for violations outlined in the User Conduct and Rules on the Platform.

• Classicbuy Credits can only be used within the registered account and have specific usage restrictions.

• Classicbuy may terminate accounts in accordance with its Terms of Use, leading to the forfeiture of certain credits earned under specific circumstances.

Contents Posted on Platform

All content, including text, graphics, user interfaces, photographs, trademarks, logos, sounds, music, and artwork ("Content"), is third-party user-generated content, and Classicbuy serves as an intermediary under these Terms of Use. Classicbuy does not control such third-party user-generated content but reserves the right to use the Content or its elements worldwide, perpetually, and transferable. Users grant Classicbuy the rights to use the Content for promotional, advertising, and derivative work creation purposes, consistent with the Privacy Policy.

Users may use information on products and services available on the Platform for personal, non-commercial informational purposes, provided they do not remove proprietary notice language, make modifications, or post the information on any networked computer or media.

In the event of a return or cancellation affecting an offer's minimum required threshold, the user may be deemed ineligible for the offer, with any credited cashback voided and deducted from the item's value. Classicbuy reserves the right to modify terms and conditions without prior notice.

Disclaimer of Warranties and Liability

Materials, products, and services on the Platform are provided on an "as is" and "as available" basis without any express or implied warranties. Classicbuy does not guarantee constant availability of the Platform or the completeness, truth, accuracy, or non-misleading nature of the information. Products sold on the Platform are subject to different state laws, and if delivery is impossible due to state law implications, the Seller will return or credit the amount received in advance.

To place an order on the Platform, a valid phone number is required, and users consent to be contacted via phone calls and/or SMS notifications for order-related updates. Personal information will not be used for promotional calls or SMS.

Selling

Registered sellers may list items for sale on the Platform in compliance with the Policies incorporated into these Terms of Use. Sellers must legally be able to sell listed items and ensure they don't infringe on third-party rights. Listings must accurately describe the item's condition, be placed in appropriate categories, and be kept in stock for successful fulfillment. Misleading listing descriptions require sellers to refund buyers. Listing a single product in multiple categories is prohibited, and Classicbuy reserves the right to delete such listings.

Classicbuy may offer alteration services for garments purchased, with a nominal convenience charge applicable for pick-up, drop-off, or tailor visits, as mentioned by Classicbuy during the alteration request.

Payment

When using any payment method on the Platform, Classicbuy shall not be liable for any loss or damage directly or indirectly arising due to:

• Lack of authorization for a transaction.

• Exceeding the mutually agreed preset limit.

• Payment issues arising during the transaction.

• Decline of the transaction for any reason.

• Payments for purchases/services on the Platform must be in Indian Rupees acceptable in the Republic of India. Classicbuy will not facilitate transactions in any other currency.

Before delivering an order, the Seller may request supporting documents (e.g., Govt. issued ID and address proof) to establish ownership of the payment instrument used.

Transactions and commercial terms are contractual obligations between the Buyer and Seller. Classicbuy's role is to facilitate the transaction, and it is not liable for non-delivery, damages, or fraud related to the listed products/services.

Classicbuy is authorized to collect, process, and remit payments electronically using existing banking infrastructure. The Payment Facility is not a banking or financial service but a facilitator for electronic transactions.

Payment Facility for Buyers

As a Buyer, when initiating a transaction, you enter into a legally binding contract with the Seller. The Payment Facility is used to pay the Transaction Price through your Issuing Bank to the Seller.

Refunds will be in Indian Rupees and processed through NEFT/RTGS or other online banking/electronic funds transfer systems. Some banks may not support refunds, requiring alternate bank account details.

Buyers may agree to extension/increase in dispatch/delivery time through electronic communication. Refund claims for non-delivery or delayed delivery should be raised within the specified time.

Refunds are conditional and subject to Buyer compliance with policies. Classicbuy may impose limits on Transactions, and refusal may occur based on Buyer history or credibility.

Classicbuy may delay payment confirmation or hold Transaction Price for safety reasons. Classicbuy is not liable for damages resulting from non-processing or delay in processing beyond its control.

Compliance with Laws

Buyers and Sellers must comply with applicable laws, including the Foreign Exchange Management Act, 1999, Customs Act, Information and Technology Act, 2000, Prevention of Money Laundering Act, 2002, Income Tax Act, 1961, and Export Import Policy of the Government of India.

Buyer's Arrangement with Issuing Bank

All payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure. Terms and conditions between the Buyer and the Issuing Bank govern these transactions. Online Bank Transfers from Valid Bank Accounts are processed through the Issuing Bank's gateway, also governed by the terms agreed to between the Buyer and the respective Issuing Bank.

E-Platform for Communication

You acknowledge that Classicbuy is an online platform facilitating product purchases at the indicated prices. Classicbuy operates as a facilitator and is not a party to or in control of any transactions on the platform.

Indemnity

You agree to indemnify and hold Classicbuy, its owner, licensee, affiliates, subsidiaries, applicable group companies, and their respective officers, directors, agents, and employees harmless from any third-party claims, demands, actions, or penalties, including reasonable attorneys' fees. This indemnification is based on your breach of the Terms of Use, Privacy Policy, other policies, or violation of laws, rules, regulations, or third-party rights, including intellectual property rights.

Trademark, Copyright, and Restriction

Classicbuy controls and operates the platform, with products sold by respective sellers. All platform materials, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. The material on Classicbuy is for personal, non-commercial use only. You must not copy, reproduce, republish, upload, post, transmit, or distribute the material in any way, directly or indirectly, via email or electronic means, and you must not assist others in doing so.

Modification of materials, use on other Classicbuy or networked computers, or any purpose other than personal, non-commercial use without prior written consent is a violation of copyrights, trademarks, and proprietary rights, and is prohibited. Commercial use, whether remunerated or not, is subject to this prohibition.

You retain ownership and responsibility for any content you provide or upload, including text, data, information, images, photographs, music, sound, video, or other materials. However, Classicbuy reserves the right to use/reproduce any content uploaded by you, and you grant a royalty-free, irrevocable, unconditional, perpetual, and worldwide right to Classicbuy for reasonable business purposes.

Limitation of Liability

Classicbuy shall not be liable for any indirect, punitive, incidental, special, or consequential damages arising from:

• The use or inability to use the Services or Products.

• Unauthorized access to or alteration of user transmissions or data.

• Breach of conditions, representations, or warranties by the manufacturer of the Products.

• Any matter related to the services, including damages for loss of use, data, or profits.

Classicbuy is not responsible for the non-availability of the Platform during maintenance or unplanned access suspensions. Users acknowledge that downloading material or data from Classicbuy is at their own risk, and any damage to their device or data loss is their sole responsibility. Classicbuy's liability is limited to the value of the purchased Products. Classicbuy is not liable for disputes between Users.

Termination

Classicbuy may suspend or terminate a user's use of the Platform if it believes the user has violated the Terms of Service or acted unethically. These terms survive indefinitely unless terminated by Classicbuy.

Upon termination, Classicbuy may delete user content but may preserve transaction details for tax or regulatory compliance. Termination may result in the forfeiture of earned Classicbuy credits.

Classicbuy can unilaterally terminate an account for reasons specified in the User Conduct and Rules on the Platform. Returns/refunds for terminated users are at Classicbuy's discretion. Refusing access or terminating accounts may occur if false information is used, unlawful or fraudulent activities are detected, or if there is a violation of company policies.

Jurisdictional Issues/Sale in India Only

Materials on the Platform are presented for sale in India. Classicbuy does not guarantee materials' appropriateness or availability for use in locations/countries other than India. Users accessing the Platform from locations/countries other than India do so at their initiative, and Classicbuy is not responsible for product supply/refunds or compliance with local laws in such locations/countries.

Governing Law

These terms shall be governed by and construed in accordance with the laws of India, without reference to conflict of laws principles. Disputes shall be subject to the exclusive jurisdiction of courts, tribunals, and authorities in India, and the place of jurisdiction shall exclusively be in Indian courts.

Classicbuy is committed to resolving disputes between Sellers and Buyers through dispute resolution mechanisms. Disclaimer

You acknowledge that you access the services on the Platform and transact at your own risk, using your best judgment. Classicbuy shall not be liable for actions or inactions of sellers, breaches by sellers or manufacturers, and expressly disclaims any responsibility and liability. Classicbuy does not mediate disputes between users and disclaims any warranties or representations regarding product quality, accuracy, reliability, and other aspects. The content on the Platform is provided as-is, without warranty of any kind.

Delivery Related

• Claims regarding order delivery must be notified to Classicbuy within 2 days from the alleged date of delivery.

• Non-notification within the specified time shall be construed as deemed delivery.

• Classicbuy disclaims liability for claims regarding non-delivery or non-receipt after 2 days from the alleged date of delivery.

Cart Notification

If selected products in your cart are out of inventory, Classicbuy offers you the option to choose a similar product from another seller. You acknowledge that the price of the alternative product may differ.

Multiple Sellers

Products of a particular style may be sold by multiple sellers on the Platform, and the listed price may not always be the lowest. The seller displayed on the list page is chosen based on various parameters, and price is just one factor. Once you reach the product display page for a specific style, you can view the prices offered by all sellers for that style.
